Section 8.1 Definition of Confidential Information.   Confidential information includes, but is not limited to, written and verbal information provided by the Client concerning the Client's business activities, plans, trade secrets, finances, data, operating methods and projects, officers, directors  and employees, and finally, customers.

Section 8.3 Limitations. The confidentiality and non-disclosure obligations under this Agreement shall not apply to Confidential Information that: (1) was in the possession of the Service Provider at the time of revelation and that had no existing confidentiality restrictions, (2) at the time of disclosure was in the public domain or was made generally available to the public after disclosure, (3) has been received from a third party without restriction on disclosure and without breach of agreement or wrongful act by the Service Provider, (4) is independently developed by the Service Provider without reference or use of the Confidential Information, or (5) is required to be disclosed by law or regulatory agency or a court of competent jurisdiction.

Section 8.4 Enforcement of Confidentiality and Non-Disclosure Clause.  If this clause is breached, Service provider agrees that the Client may seek immediate injunctive relief or other equitable relief, including but not limited to a temporary restraining order or preliminary injunction issued by a court of competent jurisdiction to prevent or further limit damages.  Any injunctive or equitable relief is in addition to other enforcement measures that are available for breach of contract.

Section 8.5   Disposal of Client Confidential Information.  At the Client's express request, upon termination of this Agreement, Service Provider will dispose of the Client's Confidential Information, including original digital data and copies except for one copy which the Service Provider shall maintain in its files for it own records and for legal reasons.
